These Terms of Service ("Terms") govern your access to and use of our cold email platform ("Service"). By using our Service, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you:

Are at least 18 years old
Have the authority to enter into these Terms
Will comply with all applicable laws and regulations
Will use the Service for legitimate business purposes only

2. Acceptable Use Policy

You must NOT use our Service to:

Send spam or unsolicited bulk emails
Send emails to purchased or scraped email lists without consent
Violate CAN-SPAM Act, GDPR, or other anti-spam laws
Send phishing, malware, or malicious content
Impersonate others or use false headers
Send emails containing illegal content
Harass, threaten, or abuse recipients

Violations will result in: Immediate account suspension or termination without refund.

3. Your Account

Registration: You must provide accurate information when creating an account.

Security: You are responsible for maintaining the security of your account credentials.

Unauthorized Access: Notify us immediately if you suspect unauthorized access.

One Account: Each user may only maintain one account unless explicitly authorized.

4. Subscription & Payment

Free Plan: Limited to 50 emails per month with basic features.

Pro Plan: $19/month or $190/year, includes 10,000 emails per month and advanced features.

Billing: Subscriptions auto-renew. You can cancel anytime from your billing page.

Refunds: No refunds for partial months. Cancellation takes effect at end of billing period.

Price Changes: We may change prices with 30 days advance notice.

5. Email Sending Limits

Monthly email limits are strictly enforced:

Free: 50 emails/month
Pro: 10,000 emails/month

Limits reset on the first day of each month. Unused emails do not roll over. Exceeding limits will pause your campaigns until next month or upgrade.

6. Your Data

Ownership: You retain all rights to your data (contacts, templates, emails).

Data Use: We use your data only to provide the Service and as described in our Privacy Policy.

Backup: You are responsible for backing up your data. We provide export features.

Deletion: Upon account deletion, your data is permanently removed within 30 days.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

Perform scheduled maintenance with notice
Experience unexpected downtime
Modify or discontinue features with notice
Suspend service for security or legal reasons

8. Termination

By You: Cancel anytime from billing page. Access continues until period ends.

By Us: We may suspend or terminate accounts that violate these Terms, without notice or refund.

Effect: Upon termination, you lose access to the Service and your data may be deleted.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

Email delivery rates
Campaign success or results
Compatibility with all email providers
Error-free operation

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

Lost profits, revenue, or data
Indirect, incidental, or consequential damages
Damages exceeding amount paid in the last 12 months
Damages from email delivery failures or bounces

11. Legal Compliance

You must comply with all applicable laws, including:

CAN-SPAM Act (USA): Include unsubscribe links, valid sender info, accurate subject lines
GDPR (EU): Obtain consent before sending, honor unsubscribe requests
CASL (Canada): Get consent, identify yourself clearly
Other Laws: Local anti-spam and privacy regulations

12. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
